These Terms of Service (the “Terms”) are a binding agreement between you and LiminalArc LLC (“LiminalArc,” “we,” or “us”) and govern your use of www.liminalarc.co, any subsite, subdomain, or successor site, and any related content, features, and communications, including our text messaging program (together, the “Website”).

By accessing or using the Website, or by opting in to receive text messages from us, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Website or opt in to our messages.

You must be at least 18 years old, or the age of majority where you live, to use the Website or enroll in our text messaging program. The Website is not intended for children under 13.

Use of the Website

You may use the Website only for lawful purposes and in line with these Terms. We may suspend or end access at any time, for any reason, including if we believe you have violated these Terms.

You agree not to:

• Violate any law or the rights of others, including intellectual property and privacy rights.
• Interfere with or disrupt the Website, its servers, or its networks, or attempt to gain unauthorized access to any part of it.
• Introduce viruses, malware, or other harmful or destructive code.
• Use bots, scrapers, or other automated means to collect data from the Website without our written permission.

• Use the Website to send unsolicited or unlawful communications.

Intellectual Property and Submissions

SMS Terms and Conditions

• Program description. LiminalArc operates a text messaging program (“LiminalArc Text Messages”). If you opt in, we will send text messages to the mobile number you provided, such as [describe message types, e.g., event reminders, service updates, and related notifications]. Messages are sent through our messaging platform and wireless carriers.
  
• Consent. By providing your mobile number and opting in, you agree to receive these messages. Consent is not a condition of purchasing any goods or services, and you do not need to join the program to use the Website.
  
• Message frequency. You can expect up to 4 messages per month.
  
• Rates. Message and data rates may apply, depending on your carrier and plan. You are responsible for any charges from your carrier.
  
• Opting out. You can opt out at any time by replying STOP to any message or by emailing data@liminalarc.co. We will honor other reasonable opt-out requests, send one confirmation message, and then stop texting you. You can rejoin at any time by opting in again.
  
• Help. For help, reply HELP to any message or email data@liminalarc.co.
  
• Delivery. Delivery is subject to your carrier and device. LiminalArc and the wireless carriers are not liable for delayed or undelivered messages.
  
• Privacy. We use your mobile number and consent records only as described in our Privacy Policy. We do not share mobile phone numbers or SMS opt-in and consent data with third parties or affiliates for their own marketing or promotional purposes.
  
• Changes to the program. We may change or end the program at any time. If the program changes materially, we will tell you before the change takes effect where the law requires it.

The Website may link to websites operated by other parties. We do not control those sites and are not responsible for their content or practices. A link does not mean we endorse the site or its operator. Their terms and privacy policies apply when you use them.

• Disclaimer. The Website is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, secure, or error-free.

Governing Law, Changes, and Contact

• Governing law. These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Any dispute will be brought in the Georgia or federal courts located in Gwinnet, Georgia, and you consent to their jurisdiction.
  
• Changes to these Terms. We may update these Terms from time to time. Changes take effect when we post the revised Terms on the Website, and your continued use of the Website or our text messages means you accept them. The effective date at the top of this page shows when the Terms were last updated.
  
• General. If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and the Privacy Policy are the entire agreement between you and LiminalArc about the Website.
